Official language (used for official purposes of the Union)
Rules, 1976
(As amended, 1987, 2007 and 2011)
GSR 1052 - In exercise of the powers conferred by section 8 read with sub-section (4) of section 3 of the Official Languages Act, 1963 (19 of 1963), the Central Government makes the following rules, namely: -
Short title, extent and commencement--
These rules may be called the Official Languages (Use for Official Purposes of the Union) Rules, 1976.
It extends to the whole of India except the state of Tamil Nadu.
They shall come into force on the date of publication in the Gazette.
Definitions - In these rules, unless the context otherwise requires: -
'Act' means the Official Languages Act, 1963 (19 of 1963);
The following is also under 'Central Government Office', namely: -
Any ministry, department or office of the Central Government;
Any office of any commission, committee or tribunal appointed by the Central Government; And
An office of a corporation or company owned or controlled by the Central Government;
'Employee' means a person employed in an office of the Central Government;
'Notified office' means a notified office under sub-rule (4) of rule 10;
'Proficiency in Hindi' means proficiency described in Rule 9;
'Region A' means the States of Bihar, Haryana, Himachal Pradesh, Madhya Pradesh, Chhattisgarh, Jharkhand, Uttarakhand, Rajasthan and Uttar Pradesh and the Andaman and Nicobar Islands, Union Territory of Delhi;
'Region B' means the States of Gujarat, Maharashtra and Punjab and the Union Territories of Chandigarh, Daman and Diu and Dadra and Nagar Haveli;
'Region C' means the States and Union Territories other than the States and Union Territories referred to in clauses (f) and (g);
Working knowledge of Hindi means working knowledge described in Rule 10.
Communications with Offices other than State etc. and Central Government Offices
A communication from a Central Government office to a State or Union Territory in Region 'A' or to an office (which is not an office of the Central Government) or a person in such State or Union Territory shall be in Hindi except in exceptional circumstances and if they contain If any letters are sent to someone from English, their Hindi translation will be sent along with them.
From Central Government Office-
In Region 'B', communication to a State or Union Territory or to an office (which is not an office of the Central Government) in such State or Union Territory shall be generally in Hindi and if any of these communications are sent in English, then Their Hindi translation will also be sent along with them: but if any such State or Union Territory wishes that the correspondence of a particular class or category or any office intended for its office be in English or Hindi for the period specified by the Government of the concerned State or Union Territory. If we send it in translation and also its translation in another language, then such communication will be sent in the same manner;
Correspondence can be sent in Hindi or English to a person in a State or Union Territory of Region 'B'.
Communications from a Central Government office to a State or Union Territory in Region 'C' or to an office (which is not an office of Central Government) or a person in such State shall be in English.
Notwithstanding anything contained in sub-rules (1) and (2), from the office of the Central Government in Region 'C' to any State or Union Territory in Region 'A' or 'B' or any office in such State (which The central government may not have an office) or the person may have communication in Hindi or English. However, the communication in Hindi will be in such a proportion that the Central Government may decide from time to time keeping in mind the number of persons having working knowledge of Hindi in such offices, facilities for sending communication in Hindi and related matters.
Communications between Central Government Offices
Communications between any one Ministry or Department of the Central Government and any other Ministry or Department may be in Hindi or English;
Communications between a Ministry or Department of the Central Government and attached or subordinate offices located in Region 'A' shall be in Hindi and in such proportion as the Central Government, the number of persons having working knowledge of Hindi in such offices, sending communications in Hindi Determine from time to time, keeping in mind the facilities and related matters;
Between such Central Government Offices located in Region 'A', other than those specified in Section (A) or Section (B), the correspondence shall be in Hindi;
Communications between the Central Government Offices located in Region 'A' and Central Government Offices located in Region 'B' or 'C' can be in Hindi or English;
But these communications will be in such proportions in Hindi that the Central Government may decide from time to time keeping in mind the number of persons having working knowledge of Hindi in such offices, facilities for sending communications in Hindi and related matters;
Communications between Central Government offices located in Region 'B' or 'C' may be in Hindi or English;
But these correspondence will be in such proportion in Hindi that the number of persons having working knowledge of Hindi in such offices of the Central Government, in Hindi.
